The Black Sash and the Legal Resources Centre have won a three year battle to reverse a regulation which limited back pay to only three months. The government's decision to amend the Social Assistance Act regulation in April 1998 allowed the department to limit back pay to only three months. Before then, a successful applicant had the right to payment from the date of application, no matter how long the department took to process it. The amendment caused much hardship to social grant recipients (for pensions, disability, care dependency, child support or foster care), generally the poorest people from the country. The grounds on which the Black Sash fought this amendment included a number of constitutional challenges, including the right to dignity. This step is also in line with the state's obligation to progressively realise people's rights to social security provided for in section 27 of the Constitution of South Africa.
The present Minister of Social Development, Zola Skweyiya, agreed to the terms of an Order of Court in the Transvaal Provincial Division. This means that anyone who successfully applied for pension or grant after March 31, 1998 and waited for more than three months before receiving benefits, is entitled to back pay.
